1. Acceptance of Terms

By purchasing a membership or accessing Sharpe Athletic Pty Ltd (ACN 11 671 965 398) (“Sharpe Athletic”), you agree to comply with these Terms and Conditions (“Agreement”). Do not use our services if you do not agree.

2. Definitions

  • Facility/We/Us: Sharpe Athletic Pty Ltd.
  • You/Member: Individual named on the membership account (may differ from payer).
  • Website: http://sharpeathletic.com or other notified addresses.
  • Stripe/PushPress: Third-party payment agents acting for Sharpe Athletic.

3. Payment Authority

You authorise Sharpe Athletic, Stripe, PushPress, or any nominated agent to debit your nominated bank account or credit card for all fees due under this Agreement and your membership.

4. Health, Safety, and Participation

  • You confirm you are medically fit for exercise. If unsure, seek medical clearance before use.
  • All members and visitors must complete a PAR-Q and notify staff of any health risks.
  • You use the facility at your sole risk and accept all risks involved in physical activity.
  • If you become pregnant, injured, or ill, you must inform management and provide clearance to resume.

5. Membership, Fees, and Payment Terms

  • Membership type, start date, term, inclusions, and fees are set out in your onboarding documents or app.
  • Payment is by direct debit. Keep your details up to date.
  • Failed payments result in suspended access until payment is made. Dishonour/late fees may apply.
  • We may change fees with 14 days’ written notice; you may cancel during this window without penalty.
  • Minimum commitment applies if stated. Early termination during this period may incur a fee (see onboarding for amounts).

6. Cooling-Off, Cancellations, Suspensions

  • Cooling-Off: Cancel in writing within 7 days of joining for a full refund.
  • Cancellation by Member: 14 days’ written notice required after minimum term. Cancelling during minimum term may incur an early exit fee.
  • Suspension: Freeze is available for medical or travel reasons (minimum 7 days, max 8 weeks per year), subject to a weekly fee and approval.
  • Cancellation by Sharpe Athletic: We may suspend or terminate membership immediately for non-payment, breach of rules, or unsafe/inappropriate conduct.

7. Refund Policy

No refunds for change of mind, non-use, or unused sessions, except as required by law.

8. Access, Behaviour, and Entry

  • Members and casual visitors must complete a PAR-Q before first use.
  • Entry denied/suspended/terminated for abusive behaviour, intoxication, unauthorised instructing, illegal activity, or any other unsafe/inappropriate conduct (management discretion).
  • No smoking, illegal substances, or performance-enhancing drugs on premises.
  • Minors under 18 may only access per Sharpe Athletic’s Age Policy (available on request and referenced below).
  • Dress code: Fully enclosed sports shoes, no offensive prints/designs.
  • Towel required on all equipment. Hire available for $5.
  • Bags are not permitted on the gym floor.
  • No overnight storage; personal items left will be kept for two weeks then donated.

9. Equipment Use

  • Use all equipment as instructed. Ask staff if unsure.
  • Return weights and equipment to racks/storage after use.
  • Clean all equipment after use with provided wipes.
  • No excessive weight dropping; warnings may lead to suspension/termination.
  • Deadlift platform: Drop pads required for lifts above 40kg.
  • We may alter equipment, classes, times, or instructors at any time with reasonable notice.

10. Sauna Use Policy

  • Bookings are required for sauna use.
  • Cancellations must be made at least 3 hours prior to your booking to avoid loss of class credit or penalty.

11. Lockers, Valuables, and Lost Property

  • Pigeon holes/lockers are not security devices. Valuables left at your own risk.
  • Bags not allowed on gym floor for safety.
  • Items not collected daily are kept for two weeks then donated to charity.

12. Guests and Visitors

  • All guests/visitors must complete a waiver and PAR-Q before entry.
  • All are bound by these Terms and Conditions.

13. Sub-Contracted Personal Trainers

  • Trainers operating as independent contractors are responsible for their own services and insurance.
  • Sharpe Athletic is not liable for contractor services, injury, or disputes.

14. Communicable Disease, Force Majeure, and Service Changes

  • We may restrict access, alter services/hours, or suspend memberships in compliance with government health orders, natural disasters, or events outside our control.
  • No refunds for such interruptions; membership may be suspended at our discretion.
  • We may change these Terms at any time. Updated versions are available on our website and at reception.

15. CCTV, Filming, and Privacy

  • CCTV operates throughout the facility for safety and security.
  • You consent to being filmed and acknowledge footage may be provided to authorities if required.
  • We may film or photograph the gym for promotional/business purposes. By signing up, you consent to your image being used unless you notify us in writing.
  • Personal information will be handled in accordance with the Privacy Act 1988 (Cth), Sharpe Athletic’s Privacy Policy, and our partners’ policies (PushPress, Stripe).

16. Marketing Consent

  • You consent to receiving marketing communications from Sharpe Athletic and related parties. Opt out at any time.

17. Liability Waiver and Indemnity

  • To the extent permitted by law, Sharpe Athletic excludes liability for any injury, illness, damage, or loss suffered on premises or in connection with our services.
  • You indemnify Sharpe Athletic against claims arising from your breach of these Terms or unsafe conduct.

18. Entire Agreement

This document, together with referenced agreements (Direct Debit Agreement, Special Terms on our website), forms the entire agreement between you and Sharpe Athletic and supersedes all prior agreements.

19. Age Policy

  • No memberships for persons under 18 years unless expressly permitted under Sharpe Athletic’s Age Policy.
  • Full Age Policy is available on request or via our website.
